Terms of Service

1. Eligibility

You must be at least 13 years old (or 16 in the European Economic Area) to use the Service. By using the Service you represent and warrant that you meet this age requirement. If you are under 18, you represent that you have your parent or guardian's permission to use the Service.

2. Accounts

You must create an account to use most features of the Service. You are responsible for maintaining the confidentiality of your login credentials and for all activity that occurs under your account. You agree to notify us immediately at hello@podium.bio if you suspect unauthorized use of your account.

You may not create an account on behalf of another person without their authorization, or use a username that is misleading, impersonates someone else, or violates third-party rights.

3. Acceptable Use

You agree not to:

• Post false, misleading, or fraudulent athletic results or personal information
• Impersonate any person or entity, or falsely claim affiliation with any person or entity
• Upload content that infringes any third-party intellectual property, privacy, or other rights
• Use the Service to distribute spam, malware, or other harmful content
• Attempt to gain unauthorized access to the Service, other accounts, or our systems
• Scrape, crawl, or systematically extract data from the Service without our prior written consent
• Use the Service for any unlawful purpose or in violation of any applicable law or regulation
• Interfere with or disrupt the integrity or performance of the Service

4. User Content

You retain ownership of the content you submit to the Service ("User Content"), including race results, photos, and certificates. By submitting User Content, you grant us a worldwide, non-exclusive, royalty-free license to use, copy, modify, display, and distribute your User Content solely for the purpose of operating and improving the Service.

You represent and warrant that you have all rights necessary to grant the above license, and that your User Content does not violate any third-party rights or applicable law.

Public profile information (name, username, results, bio) is visible to anyone on the internet. Do not post content you do not wish to be publicly accessible.

5. Prohibited Content

You may not post content that:

• Is unlawful, defamatory, obscene, or harassing
• Contains nudity or sexually explicit material
• Promotes violence, self-harm, or discrimination
• Infringes copyrights, trademarks, or other intellectual property rights
• Contains personal information of others without their consent

We reserve the right to remove content that violates these Terms and to suspend or terminate accounts of users who repeatedly violate them.

6. Lifetime Memberships and Payments

Lifetime memberships are one-time purchases that grant access to certain features and permanent recognition on your profile. All purchases are final and non-refundable unless required by applicable law.

Payments are processed by Stripe. By making a purchase, you agree to Stripe's terms of service. We are not responsible for errors or issues caused by Stripe's payment processing.

We reserve the right to modify the features included in membership tiers with reasonable advance notice. We will not remove core benefits without notifying affected members.

7. Intellectual Property

The Service and its original content (excluding User Content), features, and functionality are and remain the exclusive property of Podium. Our trademarks, logos, and service marks may not be used in connection with any product or service without our prior written consent.

8. Third-Party Links and Services

The Service may contain links to third-party websites or services. We are not responsible for the content, privacy practices, or terms of third-party services. We encourage you to review the privacy policies of any third-party services you visit.

9. Disclaimers

THE SERVICE IS PROVIDED "AS IS" AND "AS AVAILABLE" WITHOUT WARRANTIES OF ANY KIND, EITHER EXPRESS OR IMPLIED, INCLUDING BUT NOT LIMITED TO IMPLIED WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, AND NON-INFRINGEMENT. WE DO NOT WARRANT THAT THE SERVICE WILL BE UNINTERRUPTED, ERROR-FREE, OR FREE OF VIRUSES OR OTHER HARMFUL COMPONENTS.

10. Limitation of Liability

TO THE MAXIMUM EXTENT PERMITTED BY APPLICABLE LAW, IN NO EVENT SHALL PODIUM BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES, OR ANY LOSS OF PROFITS OR REVENUES, WHETHER INCURRED DIRECTLY OR INDIRECTLY, OR ANY LOSS OF DATA, USE, GOODWILL, OR OTHER INTANGIBLE LOSSES, RESULTING FROM (A) YOUR USE OF OR INABILITY TO USE THE SERVICE; (B) ANY UNAUTHORIZED ACCESS TO OR USE OF OUR SERVERS OR ANY PERSONAL INFORMATION STORED THEREIN; OR (C) ANY OTHER MATTER RELATING TO THE SERVICE.

IN JURISDICTIONS THAT DO NOT ALLOW EXCLUSION OF CERTAIN WARRANTIES OR LIMITATION OF LIABILITY, OUR LIABILITY WILL BE LIMITED TO THE MAXIMUM EXTENT PERMITTED BY LAW.

11. Termination

You may delete your account at any time from the Settings screen, which will terminate your access to the Service and delete your personal data within 30 days.

We may suspend or terminate your account at any time, with or without notice, if we believe you have violated these Terms or for any other reason at our discretion. Lifetime membership fees are non-refundable upon termination for violation of these Terms.

12. Governing Law and Dispute Resolution

These Terms are governed by and construed in accordance with applicable law. Any disputes arising from these Terms or the Service shall first be attempted to be resolved through good-faith negotiation. If negotiation fails, disputes shall be resolved through binding arbitration or in the courts of competent jurisdiction, as required by applicable law.

Nothing in these Terms prevents either party from seeking injunctive or other equitable relief from a court.

13. Changes to These Terms

We reserve the right to modify these Terms at any time. If we make material changes, we will notify you by posting the updated Terms on this page and updating the effective date. Your continued use of the Service after the effective date of the revised Terms constitutes your acceptance of the changes.
